Compensation in case of delay

Although flight delays happen often, few passengers are aware of their rights and their entitlement to compensation. Based on Regulation EC 261/2004, if you arrived at your final destination 3 or more hours later than your scheduled time of arrival, you either departed from an airport within the EU or your flight was operated by a European airline, and the delay was not caused by extraordinary circumstances, then you are entitled to compensation between 250 and 600 Euros.

Compensation in case of cancellation

European law protects passengers in cases of flight cancellations. If the airline did not give you a timely notice, you either departed from an airport within the EU or your flight was operated by a European airline, and the cancellation was not caused by extraordinary circumstances, then you are most likely entitled to compensation. The compensation ranges from 125 to 600 Euros depending on the distance of your journey.

Compensation in case of denied boarding

Most boarding denials happen due to over-bookings, when the airline sells more tickets than the available seats on the aircraft. If boarding was denied to you against your will Regulation 261/2004 protects you. If you departed from an airport within the EU or your flight was operated by a European airline, you are entitled to be paid between 125 and 600 Euros for compensation and, additionally,to be reimbursed for the full cost of your ticket or to be re-routed to your final destination at your convenience.

Compensation in case of baggage problems

Montreal Convention protects air passengers in cases of baggage delay, loss or damage. You can claim any damage caused by the delay, loss or damage of your baggage as long as there is evidence that this delay, loss or damage forced you to pay for the replacement of any items carried in your baggage. Additionally, if your baggage incident resulted in your psychological suffering you can claim moral damage. The compensation is limited for baggage delay, loss or damage to around €1,362.

Compensation in case of health risk

If you suffered an injury or illness on board the aircraft or during your embarkation or disembarkation not at your own fault, you are covered by the Montreal Convention. In this case you can claim moral damage and any costs incurred from your injury up to the amount of 113,100 SDR – around € 136,265. For any amount higher than the above, the carrier will be exonerated from its liability if it can prove that the damage was not due to the negligence or other wrongful act or omission of the carrier, or that the damage was solely due to the negligence or other wrongful act or omission of a third party.
